Terms and Conditions

1. Acceptance of Terms

By accessing or using My Quest Board (“Platform”), you agree to be bound by these Terms and Conditions (“Agreement”) and any policies incorporated by reference, including the Privacy Policy. If you do not agree, you must discontinue use of the Platform immediately.

You confirm you are at least 18 years old (or the legal age of majority in your jurisdiction) and capable of entering legally binding agreements.

2. Nature of Services

My Quest Board, LLC (“My Quest Board,” “Quest Board,” “we,” “us,” or “our”) provides an online platform allowing users (“Quest Posters”) to post tasks, jobs, or challenges (“Quests”) and other users (“Quest Workers”) to accept and complete them.

The Platform is a neutral facilitator and is not a party to any agreement between users. We do not supervise, direct, control, or guarantee any Quest or User.

3. No Employment Relationship

You acknowledge and agree that My Quest Board is not an employer, staffing agency, or labor broker. Quest Workers are not employees, agents, joint venturers, or partners of My Quest Board.

Quest Workers perform Quests as independent individuals. My Quest Board does not control how Quests are completed, is not responsible for wages, unemployment insurance, workers’ compensation, benefits, tax withholding, or any employment-related obligations.

4. User Responsibilities

4.1 Quest Posters:

• Ensure all posted Quests comply with applicable laws and safety requirements.
• Provide accurate descriptions, compensation details, and requirements.
• Handle all payments directly with Quest Workers as agreed.
• Provide any necessary access, materials, or conditions needed for safe completion.

4.2 Quest Workers:

• Perform Quests professionally, safely, and in compliance with law.
• Communicate clearly with Quest Posters regarding expectations and completion.
• Maintain any required licenses, permits, or qualifications for specific Quests.
• Use appropriate protective measures and act reasonably to prevent injury or damage.

4.3 General Responsibilities:

• All interactions between users are conducted at their own risk.
• Any agreements formed between users are strictly between those parties.
• You are solely responsible for verifying another user’s identity, suitability, and reliability.
• You must comply with all local, state, federal, and international laws applicable to your use.

5. Prohibited Activities

Users agree not to:

• Post or accept illegal, dangerous, or fraudulent Quests.
• Misrepresent identity, qualifications, pricing, or intent.
• Engage in harassment, abuse, threats, discrimination, or misconduct.
• Exploit, game, or manipulate the Coin economy or platform limits.
• Attempt unauthorized access, hacking, scraping, or interference.
• Use the Platform to distribute spam or unrelated content.

My Quest Board may remove content, restrict features, or suspend/terminate accounts for violations.

6. Payments and Fees

6.1 User-to-User Monetary Payments

All monetary rewards for Quests are exchanged directly between the Quest Poster and Quest Worker. My Quest Board does not process, hold, safeguard, guarantee, or enforce payments between users.

Payment Guarantee Disclaimer: My Quest Board does not guarantee that any User will pay another User for any Quest. Users assume all risks of direct payments, including nonpayment, fraud, chargebacks, reversals, disputes over amount, and timing.

6.2 Coin System

Internal Coins are digital credits used within the Platform. Coins may be purchased from My Quest Board using Stripe or other approved processors.

My Quest Board uses Stripe only for Coin-related transactions, not Quest rewards.

6.3 Digital Currency Risk Disclosure

• Coins are not legal tender, not a security, and not an investment vehicle.
• Coin value may fluctuate based on circulation and system rules.
• Coin value is not guaranteed and may increase or decrease over time.
• Coins are for internal Platform use only and have no guaranteed value outside the Platform.
• All Coin purchases are final once processed, unless required otherwise by law.
• Users assume all risks associated with owning, buying, selling, or using Coins.

6.4 Fees

My Quest Board may charge fees related to Coin purchases, Coin sales, spreads, or optional Platform features. Fees are disclosed at the point of transaction or within relevant pages.

7. Identity Verification & Background Checks

Certain roles (such as Worker status) may require identity or background verification through third-party providers.

• My Quest Board does not guarantee the accuracy, completeness, or currentness of third-party results.
• Background checks may not detect all past conduct or risks.
• We do not perform continuous screening unless explicitly stated.
• Users must still exercise independent judgment and caution.

8. Safety Disclaimer

Quests may involve in-person contact, physical work, or travel. Users are solely responsible for their own safety and for evaluating the risks of any Quest or interaction.

My Quest Board does not provide insurance, safety training, tools, supervision, or guarantees that any Quest location or user is safe.

9. Marketplace Transaction Disclaimer

Users negotiate and define their own contractual terms (scope, price, timing, conditions). My Quest Board does not draft, enforce, or interpret user contracts and is not responsible for dispute resolution or outcome enforcement.

10. Third-Party Services

The Platform may rely on third-party services (including but not limited to Stripe, AWS, mapping tools, analytics, and communication services). My Quest Board is not liable for outages, errors, or failures caused by third parties. Third-party terms may apply to your use of those services.

11. Intellectual Property

All trademarks, logos, text, designs, features, and software on My Quest Board are owned by My Quest Board, LLC or its licensors. Users may not reproduce, modify, or distribute Platform content without written permission.

By posting content, you grant My Quest Board a non-exclusive, worldwide, royalty-free license to display and use that content for Platform operations.

12. Disclaimers

My Quest Board is provided “as is” and “as available” without warranties of any kind. My Quest Board does not guarantee:

• The completion, quality, legality, or safety of any Quest.
• The behavior, identity, qualifications, or actions of any User.
• The accuracy of user-generated content.
• That any User will pay or perform as agreed.
• Uninterrupted or error-free service.

13. Limitation of Liability & User Release

To the fullest extent permitted by law, My Quest Board, LLC is not liable for any direct, indirect, incidental, special, or consequential damages arising from:

• User-to-user interactions or agreements.
• Injuries, property damage, or losses during Quest performance.
• Failed, delayed, or fraudulent payments between users.
• Barter disputes or losses.
• Coin value changes or Coin transaction issues.
• Use or misuse of the Platform.
• Errors, interruptions, or technical issues.
• Third-party service failures.

User Release: You hereby release and hold harmless My Quest Board, LLC and its owners, officers, employees, affiliates, and agents from any claim, demand, loss, injury, or liability arising from the acts or omissions of other Users.

To the maximum extent permitted by law, My Quest Board’s total liability for any claim will not exceed the greater of $100 or the fees you paid to My Quest Board in the prior six months, if any.

14. Indemnification

You agree to indemnify and hold harmless My Quest Board, LLC, its owners, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) resulting from:

• Your use of the Platform.
• Your actions, negligence, or misconduct toward other users.
• Disputes between you and any other party.
• Your violation of this Agreement or any law.
• Your content or listings.

15. Account Suspension and Termination

My Quest Board may suspend or terminate your account at any time for violations, fraud, misconduct, security concerns, or platform abuse, including but not limited to:

• Chargeback abuse or payment fraud related to Coins.
• Attempting to manipulate circulation-based Coin pricing.
• Repeated unsafe, illegal, or misleading Quest postings.
• Harassment, threats, or abusive behavior.
• Circumventing platform limits or rules.
• Unauthorized access attempts or technical abuse.

Upon termination, My Quest Board may remove content, disable access, and temporarily freeze Coin balances during investigation, as permitted by law.

16. Data Retention and Content Removal

My Quest Board may remove or restrict any content that violates these Terms or applicable law. We may retain certain account or transaction data as needed for security, legal compliance, dispute handling, or platform integrity, even after account deletion.

You acknowledge that My Quest Board is not responsible for loss of content or data posted by Users.

17. Arbitration Agreement and Class Action Waiver

Please read this section carefully. It affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to this Agreement or your use of the Platform shall be resolved by binding arbitration on an individual basis, rather than in court, except that either party may bring claims in small claims court if eligible.

• Arbitration will be conducted in Franklin County, Ohio, unless otherwise required by law.
• The arbitrator may award the same damages and relief as a court.
• Class Action Waiver: You agree that disputes will be arbitrated only on an individual basis. You waive any right to participate in a class, collective, or representative action against My Quest Board.

If this waiver is found unenforceable, the arbitration requirement shall still apply to the fullest extent permitted by law.

18. Modifications

We may update these Terms and Conditions at any time. Continued use of the Platform after changes are posted constitutes acceptance of the updated Agreement.

19. Governing Law

This Agreement is governed by the laws of the State of Ohio. Any disputes not subject to arbitration shall be resolved exclusively in the courts of Franklin County, Ohio.
